Terms and Conditions of Use

Welcome to Astor Weiss Kaplan & Mandel, LLP’s (the “Law Firm”) website or computer application (individually and collectively referred to herein as the “Internet Applications”).  PLEASE READ THE TERMS AND CONDITIONS OF USE AND THE PRIVACY POLICY SET FORTH BELOW CAREFULLY BEFORE ACCESSING ANY PART OF THE INTERNET APPLICATIONS.  By using or accessing any part of the Internet Applications you signify your acknowledgment and assent to the terms and conditions of use (the “Terms and Conditions of Use”) and privacy policy (the “Privacy Policy”) set forth below.  If you do not agree to the Terms and Conditions of Use or the Privacy Policy, please do not use the Internet Applications.  The Law Firm may revise the Terms and Conditions of Use and Privacy Policy at any time by updating this webpage and your use of any part of any of the Internet Applications after any such revision signifies your acceptance of such revisions.  Please check this webpage periodically for changes.

The materials and information on the Internet Applications have been prepared by the Law Firm for general information purposes only and do not constitute advertising, a solicitation, or legal advice.  The materials and information contained on the Internet Applications are provided only as general information that may or may not reflect the most current legal developments; accordingly, the material and information on the Internet Applications are not promised or guaranteed to be correct or complete.  You should not rely upon the materials and information on the Internet Applications for any purpose without seeking legal advice from a licensed attorney in your state.  The Law Firm expressly disclaims all liability with respect to any actions taken or not taken based on any or all of the material and information on any part of any of the Internet Applications.

The materials and information on the Internet Applications are not intended to create, and your receipt, viewing, or use thereof does not constitute the formation of, an attorney-client relationship.  You may send the Law Firm email or communicate with the Law Firm by sending it materials and information through the Internet Applications.  However, if you communicate with the Law Firm about any matter in which we do not already represent you, your communication will not be treated as privileged or confidential and you should not send the Law Firm any sensitive or confidential materials or information.  The act of sending the Law Firm or any attorney at the Law Firm an email, or submitting any materials or information through the Internet Applications will not create an attorney-client relationship, such a relationship being created only through your execution of an engagement letter sent to you by the Firm.  The Internet Applications are not an offer to represent you.

If you communicate with the Law Firm by email or by sending it materials or information through the Internet Applications, please be advised that the security of communication over the internet is uncertain.  By sending sensitive or confidential materials or information over the internet, including by email or through the Internet Applications, you accept the risks of such uncertainty and acknowledge that any materials or information sent over the internet may be intercepted by third parties.

The Law Firm welcomes your submission of testimonials about the quality of legal services provided by the Law Firm.  By submitting a testimonial to the Law Firm, you agree to the Law Firm’s publication and distribution of your testimonial on the Internet Applications and through other electronic and physical channels of communication, and you hereby grant the Law Firm any and all necessary licenses to so publish and distribute your testimonial.  The Law Firm is under no obligation to publish any testimonial provided to it in whole or in part and you agree that the Law Firm may use only such parts of any testimonial provided to it that the Law Firm deems desirable to its marketing efforts, in its sole discretion.  You agree that the Law Firm may review all testimonials for grammatical and spelling errors, and edit or summarize testimonials prior to publication or distribution.  All testimonials published or distributed by the Law Firm will be edited to exclude personal information and conform to all laws and ethical rules.  If you do not agree with any of these terms and conditions, do not submit a testimonial to the Law Firm.

The Law Firm may provide links to other websites or locations on the internet for your convenience.  The Law Firm does not endorse, and is not responsible for, any materials or information on any website or any other location to which it provides a link or to any other third-party content that may be accessed through the Internet Applications.  The Law Firm disclaims any responsibility for the terms and conditions of use, privacy policies, information collection practices, content, accuracy, or quality of any materials or information on any website or any other location to which it provides a link.

All material and information on the Internet Applications, unless otherwise indicated, is protected by law, including, but not limited to, United States copyright, trade secret, or trademark law, as well as other state, national, and international laws and regulations.  Except as expressly provided herein, the Law Firm does not grant you any express or implied right(s) to use any of the materials or information contained on the Internet Applications.  Downloading of any materials or information from the Internet Applications does not transfer any right or ownership of any such materials or information.  You may not mirror or archive any part of any of the Internet Applications or any materials or information contained on any of the Internet Applications on any computer or server without the Law Firm’s prior written permission.

THE INTERNET APPLICATIONS AND THEIR CONTENTS ARE PROVIDED “AS IS”.  THE LAW FIRM DISCLAIMS ANY REPRESENTATION OR WARRANTY OF ANY KIND REGARDING ANY OF THE INTERNET APPLICATIONS.  WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE LAW FIRM DISCLAIMS ANY IMPLIED REPRESENTATION OR WARRANTY OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, ACCURACY, COMPLETENESS, OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ALL OF THE INTERNET APPLICATIONS, ANY WEBSITE OR ANY OTHER LOCATION TO WHICH ANY OF THE INTERNET APPLICATIONS PROVIDES A LINK, INCLUDING THIRD PARTY SITES, OR ANY OF THEIR RESPECTIVE CONTENTS.  SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU.

By using the Internet Applications you agree to indemnify and defend the Law Firm and any third party providers and distributors and their partners, officers, directors, employees, and agents from and against any claim, cause of action, or demand, including but not limited to, reasonable legal and accounting fees, brought by you, brought on your behalf, or brought by any third party as a result of your use of any of the Internet Applications.

These terms and conditions of use and the privacy policy will be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to the principles of conflicts of law.  You hereby irrevocably consent to the exclusive jurisdiction and venue of any state or federal court located in Philadelphia, Pennsylvania with respect to all disputes arising out of or relating to the use of any part of any of the Internet Applications, these terms and conditions of use, and the privacy policy.

Privacy Policy

This policy describes how Astor Weiss Kaplan & Mandel, LLP (the “Law Firm”) collects and uses information about visitors to or users of this website or computer application (individually and collectively referred to herein as the “Internet Applications”).  By using any part of any of the Internet Applications, you acknowledge and consent to the Law Firm’s practices described below.  If you have questions or comments about the policy or the Law Firm’s use of your personal information, please contact the Law Firm at internetpolicies@astorweiss.com.

The Law Firm may collect and/or track: (a) the home server domain names, email addresses, types of computer, and types of web browser used by visitors to or users of the Internet Applications; (b) the email addresses of visitors that communicate with the Law Firm through email or through the Internet Applications; (c) information knowingly provided by visitors in online forms, registration forms, surveys, etc., including but not limited to visitors names, addresses, email addresses, and other personal data; and (d) aggregate visitor-specific information on which webpages visitors access.  The Law Firm may place “cookies” on visitors’ hard drives.  Cookies can save data about individual visitors, such as the visitor’s name, password, user-name, screen preferences, the webpages of a website viewed by the visitor, and the advertisements viewed or clicked on by the visitor.  When the visitor revisits the Internet Applications, the Law Firm may recognize the visitor by the cookies on the visitor’s hard drive and may customize the visitor’s experience accordingly.  Visitors may decline to use cookies by using the appropriate feature of their web browser, if available.  However, declining to use cookies may impede the ability of the Internet Applications to function properly.  When a visitor performs a search within any of the Internet Applications, the Law Firm may record information identifying the visitor or linking the visitor to the search performed.  The Law Firm may also record limited information associated with every search request made by the visitor and use that information to, among other things, solve technical problems with the Internet Applications and to calculate overall usage statistics.

The Law Firm may use the personal data it collects for internal purposes, including but not limited to, solving technical problems, calculating overall usage statistics, product development, and content improvement.  The Law Firm will not disclose any individually identifying information to third parties, such as visitor names, visitor email addresses, visitor telephone numbers, or other personal information which visitors voluntarily provide to the Law Firm, except to the extent necessary to comply with applicable laws or legal processes (e.g., subpoenas), or to protect the rights or property of the Law Firm.  The Law Firm will cooperate with law enforcement authorities and comply with all applicable laws and regulations.

The Law Firm cannot guarantee the confidentiality of any communication, materials, or information transmitted to or from the Law Firm through any of the Internet Applications or by e-mail, and the Law Firm is not responsible for the security of information transmitted via the internet.  If you wish to communicate with the Law Firm by more private means, you may call the Law Firm on the telephone number located on the Law Firm’s website.    

Upon request, the Law Firm will provide you with a summary of any of your personally identifiable information retained by the Law Firm.  You may modify, correct, change, or update any personally identifiable information that the Law Firm has collected or may cause your personal record to be removed from the database maintained by the Law Firm by contacting the Law Firm at internetpolicies@astorweiss.com.

The Internet Applications may link to websites or other locations maintained by third parties.  Please note that these third party websites or other locations are governed by their own privacy policies and are not governed by this policy.  The Law Firm is not responsible for the content or policies maintained by these third party websites or other locations.
